TERMS & CONDITIONS

QUOTATIONS

Quotations are valid for 30 days.

Pricing is ex-studio. Freight is additional.

Pricing is subject to change without notice.

PAYMENT

Payment terms are 50% deposit, balance due prior to release of goods.

Deposit is non-refundable.

Goods remain our property until all payments are received.

We accept bank transfers, Amex, Mastercard, and Visa.

MODIFICATIONS

Design modifications outside standard specifications are often possible.

Design modifications usually incur different pricing and longer lead times. 

Requests for design modifications must be submitted in writing.

All modifications are subject to physics, time and approval.

SPECIFICATIONS

All drawings, dimensions, samples, descriptive matter, and specifications are intended as a guide only.

We reserve the right to change, alter or modify the design, dimensions, construction, or price of any item without prior written notice.

ORDER CONFIRMATION

An Order Confirmation Document (OCD) will be forwarded to you as acknowledgment of receipt of your order.

The OCD supersedes all previous correspondence in relation to your order (verbal, written, graphic, or otherwise).

The OCD includes packing and handling fees, premium airfreight services, and travel insurances.

We will proceed with your order, as per OCD, unless we receive written notification of any requested changes within 24 hours.

ORDER AMENDMENT 

Due to tight production times, the studio begins production shortly after orders are placed.

Orders may only be changed if manufacturing has not begun.

Once an order is confirmed, requests for subsequent changes must be sent in writing.

No guarantee can be made for accommodating requested changes.

Any variation agreed upon by us will incur additional costs.

SHIPPING & LEAD TIMES

An estimated lead time is supplied upon placement of your order.

Lead times commence upon receipt of deposit payment.

Works ship once balance payments are clear.

Lead times may be impacted by incorrect, missing or partial delivery information.

DELIVERY

Deliveries are arranged once works are ready for delivery.

Delivery charges cover a single delivery, at ground level, during regular weekday delivery hours.

The buyer is responsible for confirming free and easy access to the intended destination.

Once an order is dispatched, a tracking number is sent.

Transit times remain beyond our control.

The buyer or agent is responsible to monitor the tracking number, ensuring clearance by local Customs.

Customs, duties, taxes and VAT charges remain the responsibility of the buyer.

Delivering to complex destinations:

Prior to delivery, the buyer must supply full written details of any challenging access eg. stairs, delivery dock, lift etc.

We offer an inspection service, with additional fee, prior to order commencement for potentially complex deliveries.

We reserve the right to on-charge additional costs for unusual access, not advised in writing.

In the rare case of delivery proving impossible:

We may require the buyer to accept the goods and make their own delivery arrangements.

Cancellation of a booked delivery with less than 24 hours notice is subject to a cancellation fee.

In the rare case the buyer is unable to accept delivery within 7 days from our first call following the completion of your order:

A storage fee of 1% of the value of goods per week is payable.

INSPECTION

Inspection of products is required promptly upon delivery, confirming all works arrived in the manner intended.

DAMAGES

We are not responsible for damages caused by:

Couriers, freight handlers or shipping companies.

Improper unpacking, installation or assembly, removal or re-installation.

Improper cleaning solutions or methods, or failure to follow the Care & Cleaning Guide.

Improper installation of light bulbs.

Exposure to weather or unsuitable environment.

Third-party parts purchased separately.

Unauthorised restoration or repair work.

In the very rare case of items arriving damaged upon delivery:

All packaging and items must be retained by the receiver.

The receiver must note any damages on the delivery receipt from the carrier.

The receiver must take photographic evidence of the item and packaging and provide a written document. 

The receiver must submit all documentation to us within 7 days of receipt.

Failure to undertake the steps above will invalidate any insurance claim.

We are not responsible for any repairs or replacements reported beyond 7 days.

MATERIAL VARIATION

Surface finishes are designed to age in appearance.

Natural colour variation is a desirable trait, common with brass.

Brass extrusions, sheets or castings, depending on the manufacturing process, are made by various suppliers.

Variation does not hinder the physical properties of the works. 

Natural colour variation is not accepted as a reason to reject an item.

RETURNS

Due to the hand-made nature of our product, we are not able to offer returns on Custom Made fixtures.

Stock items incur a restocking fee of 20%.

CANCELLATIONS

A buyer may only cancel an order in writing within 48 hours.

Beyond 48 hours, a partial refund will be made, less 35% administration fee plus manufacturing costs. 

We reserve the right to cancel any order at any time for any reason. In this case, all payments will be returned in full.

Any sales made are expressly conditional upon Purchaser’s agreement to the terms and conditions in this document.

These terms and conditions may be modified or supplemented only by a written document signed by an authorised representative of Christopher Boots.

These terms and conditions supersede any prior and/or contemporaneous agreements or correspondence between Purchaser and Seller.

Seller reserves the right to change the Terms without notice.

LEGAL COMPLIANCE

Purchaser is solely responsible for compliance with all laws, ordinances, regulations, rules and standards relating to the installation, maintenance, use and operation of the products.

This document is given in addition to consumer guarantees and cannot exclude these rights.

LIMITATIONS OF LIABILITY

Christopher Boots, its contractors and subcontractors or suppliers of any tier, shall not be liable to Purchaser for any special, indirect, incidental or consequential damages arising from Products or from a breach of this Agreement.

Purchaser’s remedies set forth herein are exclusive and the liability of Seller with respect to the breach of this Agreement or any contract entered into between the parties pursuant hereto shall not exceed the price of the Product(s) or part on which such liability is based.

To the extent that the laws of any jurisdiction do not permit limitations or exclusions of implied warranties, incidental damages and consequential damages, the above limitations may not apply.

In such jurisdictions, the above limitations shall be enforced to the greatest extent permitted by applicable law.
